Handfeeding Agreement

Oftentimes, breeders will have other aviculturists handfeed their baby birds for them. When such an arrangement is made between two aviculturists, it is critical that the terms, conditions, obligations and responsibilities of each party be fully set forth in a written agreement. This Handfeeding Agreement attempts to address each possible contingency of a handfeeding arrangement. However, every item of the agreement between the breeder and the handfeeder is subject to change and negotiation between the parties. Change it...modify it...reword it...just use a written agreement to protect yourself in this unique relationship.

This Agreement is meant to be used as a guide for preparation of a legally-binding document. For legal advise on the terms, conditions and ramifications of the terms of such an agreement, you must seek formal legal counsel from an attorney of your choice.

Handfeeding Agreement

1. This agreement is made between the following parties:

2. This agreement governs and controls the terms, conditions and obligations of the parties hereto with regards to the following bird(s), delivered by Breeder to Handfeeder on the date this Agreement is executed:

3. This agreement shall remain in force and effect from the date of its execution until such time as the bird(s) identified at #2 are ______________ (age at which chicks are to be returned to breeder, if not being sold by handfeeder).

4. During the term of this Agreement, Handfeeder agrees to supply all necessary food, equipment and nursery paraphernalia to adequately and properly care for the bird(s) identified herein. If veterinary care is required for the bird(s) herein identified, such care shall be sought at Handfeeder's own discretion with the cost of all such care to be borne by ________________.

5. It is understood by Breeder that all aspects of the feeding and care of the bird(s) identified herein shall be left to the sole and complete discretion of Handfeeder during the term of this Agreement, except for the following:

At Breeder's request and expense, Handfeeder shall __________________________.

6. At the conclusion of the term of this Agreement, Breeder agrees to pay to Handfeeder, ________ as total reimbursement for the handfeeding of the bird(s) herein identified.

7. If, during the term of this Agreement, any bird identified at #2 should die, then it is agreed and understood that the bird(s) shall be autopsied by a veterinarian of ________________'s choice, with all costs of said autopsy to be borne by _______________. Copies of all autopsy reports and/or veterinary records shall be supplied to Breeder by Handfeeder upon their receipt.

8. Breeder generally and specifically waives any and all rights, claims or causes of action he/she may have against Handfeeder for the death or injury to any of the bird(s) identified at #2 during the term of this Agreement, including but not limited to all rights, claims or causes of action based upon the negligent handling, feeding or maintenance of said bird(s) by Handfeeder while this Agreement is in effect.

9. If, at the conclusion of the term of this Agreement, Breeder fails to pick-up the bird(s) identified herein from Handfeeder, then Handfeeder shall be reimbursed from Breeder in an amount of ________ per day/per bird for the care and maintenance of the bird(s) past the expiration date of this Agreement. It is agreed and understood that if such payment is due from Breeder to Handfeeder, Handfeeder will not release the bird(s) to Breeder until such payment is made.

10. If Breeder fails to pick-up the bird(s) identified herein within thirty (30) days from the expiration date of this Agreement, then it is understood that the bird(s) identified at #2 shall belong exclusively to Handfeeder, and Breeder specifically waives any and all ownership rights or interests he/she may have in the bird(s) identified herein.

11. This Agreement is meant to control all aspects of the Handfeeding Agreement herein identified, and it shall supersede any and all other written or oral agreements or representations made by the parties hereto with regard to handfeeding of the bird(s) herein identified.
